this competition legal?
Q.
Still have a question- contact us ?
Q. Who is running this competition.
A. We
are Husband and wife Paul and Michelle
Wood, who
after 22 years of self employment who as a result of
circumstances (not the current economy ) are doing this as a
means
to survive and pay all creditors and continue it as a competion site.
The WHY / ABOUT page is currently being updated.
Q. So
what's the catch?
A.
The Prize Competition to win this house is Dependant on advertising
revenue to make this successful but we hold the honest belief that this will succeed despite delays.
There
is NO ENTRY or other FEE,
and no Intention
of anything other than, to hold this genuine Prize Competition
Ir is intended that the
prize property will be paid in full and free from all
encumbrances through the means of
advertising revenue. Some
lucky person (or group of people if you get together with friends) will
win a prize of a character detached property of approx 1800 sq feet
there is a small private garden, its most recent valuation
was
£425,000, plus we will pay the stamp duty, solicitors fees
and at our
discretion
maybe other extras.
Think
about it no
one is
going to do all this in public unless they know its all above
board. Please
Read the Terms and Conditions.
E D
We
have designed the current site so that to reach another page (remember
there are up to 4 entry routes on each page) you have
to scroll to the bottom of each page and have further
designed it so that when you find an AD route and have entered you are
guided to the next page and so on in order that if you intend to enter
20 times you will have rotated through all pages up to three times in
succession.
Q.
Which
charities.
We have re-decided that on the event of reaching our target about who
we would give charitable donations to.
We have not approached any as yet but we
assure everyone this will be done through a solicitor and the
charities will be genuine and a condition will be that it can be
published to the public so that it is seen to be genuine.
Q.
How can I advertise
A. Contact us for details
Q. Can I enter if I am not from
the UK
A.
Well
we would like everyone
to
be able to enter but obviously there are laws as to which countries can
participate. We are of the understanding that people resident
in the US are not allowed to participate (but this might simply be a
tax on prize issue which could be resolved by either our paying the tax
if we raised enough or if as our terms and conditions allow by selling
the house for whatever it raised paying the tax and using the rest to
pay the winner)
There are plenty of
Americans with families and friends legally residing in the UK or other
countries that are eligible for entry so pass it on to them,
it all clocks up karma. It’s your
responsibility to ensure
you know if you are allowed to participate from your country.
All EU and common wealth countries would probably be allowed but it is
your duty to ensure.
AMENDMENT TO CAN I ENTER IF I AM NOT FROM THE UK
As
we have had a few recent queries regarding this issue we are amending
this to express our current, not-non-uk-legally-supported, knowledge or
opinion only.
Whilst we have knowledge of UK law, if you can appreciate we have no
knowledge of the laws of other countries.
The cost issue of finding out such such is possibly why a lot of UK
competitions exclude other countries, possibly not
Any one must be over 18, all English residents are OK and we are
(merely) assuming ALL British commonwealth subjects are eligible,
(which we are led to believe are Canada Australia some carribean
countries etc) and of course we are (simply assuming) all EU member
state residents are eligible.
There may be other countries that are eliglble but if you can
appreciate we cannot know this for sure.
Perhaps the way it has been reported in the US as it apparently has,
that has clearly encouraged US visitors, might be because it is known
by these sources that it is OK, perhaps not I honestly cannot say
We have had conflicting information on the US.
We have seen many competitions that state `not open to US citizens`,
we have seen information that states it is down to each individual
state and
we have seen a large national-bank-sponsored site that holds
competitions with prizes (albeit small) but did appear to be open to US
citizens but they recently appear to have changed this to open to `non
uk entrants`
To find English law we go to www.opsi.gov (and a number of other sites)
and we are aware the US constitution, and no doubt much other US law is
on line somewhere as we have seen it in the past. So it
should be
relatively easy to find out the laws from the US or other countries
It might be that it is an issue for paid competitions as other comtries
want to keep money in the country as I honestly believe I have seen an
old law implying such) in the past, if that were the issue then clearly
this time it would not be an issue as no money is going out of
the
country
A few earnest hours internet research starting by typing in different
strings of words might help.
Any decision by an entrant to take advantage of the
free opportunities by entering until they find out
must
be at their own risk and that should it transpire they cannot they
would forfeit the prize. There is ample time before the current, or any
extended deadline, to find
this out.
Q.
What are
my chances of winning?
A.
Well
given that is free
therefore no pre-determined number of ticket sales its hard to put a
finger
on it as no one can guess how many people will enter or how many times
each will play but we are giving everyone the opportunity to enter for
Free each day up to 20 times for the opportunity to win
entry into the Final Prize Competition. There are two
question
stages to be successfully completed before entry into THE FINAL .
All the details of how to enter are on the home page and throughout this site but we have
devised the competition so that people may enter as many times as they
like UNLESS they are selected as the one successful entrant per week
for a place in THE FINAL
There will be NO MORE THAN 21 finalists even though circumstances
beyond our control have already altered, or may still alter, aspects.
You could get together with friends and family to
share the prize. Please feel free
to act as an agent for
a family member or friend who is either unable to play due to a
disability, cannot read or because they have no means of
Internet access.... (though most libraries provide free access and are
excellent places,)...You can create a valid email address
for them in their name but if they win, it will be they who are legally
entitled to claim so make sure you have joint agreements in place to
avoid heated debates or worse fisticuffs.
We
understand fully the need to protect vulnerable people when Prize
Competitions are to be paid for. This however is
free.
Q. What
does
the winner have to pay for?
A.
Nothing.
Subject to
circumstances beyond our control the mortgage
and encumbrances will be paid in full so the house will be
free from these and bills will
be paid up to date, we will pay the stamp duty and conveyancing costs.
However we might at our discretion, (and subject to circumstances that
might
occur that are beyond our control as remember it is dependant
on
reaching sufficient advertising ) we might allow for 12 months rates if
the winner is moving straight in.
You are
currently entitled to a rate free, and half rate-free period if the
house is
empty for whatever reason. (you may have entered to win it to sell
it) So you pay
nothing at all.
Q. How and when are the selection
processes and The Final going
to take place ?
A.
Once the competition starts on the 2nd Nov 2009, then after
that first
day, starting on the second day and then every following day
at 7
o'clock each morning British time, the previous day's 20 DAILY,
correct-question-qualifying, entry routes are closed.
Thedetails of the last daily entry route process will close
at
7 o'clock on the morning of the date to be determined (due to
circumstances beyond our control having altered the original deadline,
it will be as soon as is possible and we are working without rest to
make this happen and have every confidence this will happen)
Up to the tempoaray halting 1 entrant from each of the 20 routes,
therefore 20 per day = 140 per
week, were selected to enter each weekly final. The temorary halting
and the temporary competition however means that inaddition to the 140
weekly finalists of each of the 4 remaining weeks when the competition
returns means that there will be more weekly finalists in each of the
remaining 4 weekly finals as the sum total of each one daily
temporary finalist will be divided into 4 groups and each group will be
have the opportunity to be entered into one of the weekly finals
Each daily and weekly finalist will be drawn and listed on the site
in the finalist gallery after 24 hours of each selection
Weekly selection processes of those of the 140 daily successful
entrants
to answer the weekly question correctly (and the additional finalists
from the four groups as mentioned above) take place (every
Tuesday starting on the FIRST TUESDAY AFTER the first week
Mon -
Sun
period, this delay is to give successful daily entrants time
to
try to enter their relevant weekly stage
The actual Final winner will be selected in 2010. (due to engineered circumstamces beyond our control needing an
extention of time this date is still to be determined) Two reserves will also
be
selected. The
winner has up
to 30 days to respond....... (updates
as to contact progress will be published on the site) .......from
either telephone or recorded delivery letter contact from us otherwise
an
`alternative winner` is the first reserve person drawn. We
hope the final winner does not wish to remain private but if they did
both our and their solicitor would make statements to be published to
verify that a genuine person / winner exists
Q. Why
21 finalists and why daily and
weekly
A. Simply due to the potential sheer volume of
possible entrants given that this is the Internet community we wished
to make this attractive (only a handful of finalists) to entrants but
not too simple hence the two (daily and weekly) question system.
Even up to the last daily entry route and selection process that starts
at 9, oclock on the final entry start-morning and closes
at seven
the
following morning entrants may still enter as long as they have not
already been selected for THE FINAL
By spreading the competition out it
allows us to keep our advertising as low as possible
Q. What
happens if you do not reach the amount needed through advertising?
A.
We
are confident we will even though the advertising market is in decline
due to companies cutting back on marketing budgets as we believe this
is an inexpensive innovative concept and marketing platform combined,
but as you are curious we will
answer.
We reserve the right to extend our deadline date for
the Prize Competition and THE FINAL in order ensure there are
sufficient funds (longer exposure,
more advertising) .
If however, we do not
reach enough to
cover everything
the winner will
A. Receive a lessor property and cash prize up to but no more
than the value of the intended prize.
B. win a lessor valued property
C. win a cash prize that being an amount of
money from that received after VAT,
operating
costs, expenses and charity gifts but not to a greater value than the
intended property.
Of course we reserve the right to cancel this at any time without
giving a prize if circumstances beyond our control deemed it necessary
You need to read the terms and conditions to find out
more.
We however only foresee a positive result of a successful winner
receiving the intended prize.
Q. Does
the House come with any Guarantees?
A.
No. there are no damp proof or other guarantees but it all seems pretty
sound and we have lived in it for 12 years . There are some
minor cosmetic jobs that need
attending to which will be fixed once we have the full advertising
money in place.
But
no we make no warranties or guarantees whatsoever
Q.
Does
the house come furnished?
A.
No but we might decide to include some at
our discretion
Q. When
would the winner actually take possession of the house?
A.
As soon as the winner is selected in the FINAL in 2010 (date
extended and as yet undetermined due to 'circumstances' that have
occurred beyond our control. The winner will be contacted and has
up to
30
days to respond, they then need to give their solicitors
details,
remember we are paying for this. If the winner needs help
in choosing a solicitor they can go to the law society web page whereby
they can seek advice from there. Then just like any house
conveyance it is dependent on how quickly the solicitors work
Q. How
will I know if I am either a finalist or the winner?
A.
First there will be plenty of clear updates as to events.
The
day after each daily and weekly selection stage we will
place the non-too-personal
user name and town of the
daily and weekly selected entrants in the finalist gallery and as soon
as possible. You can check out the galleries now to see who has been selected to date.
Hopefully
any of these and The Final Winner will provide better details but we
have to respect their right to privacy.
However
as the public
need to know it's a fair, honest and open competition we assure you
that for the winner our solicitors
will be satisfied to the best degree as can be reasonably expected that
the winner is genuine and legally entitled and solicitors
statements to say that the named User name is a genuine winner
No
other
information will be published about the daily and weekly successful
entrants unless
they
consent.
The
day after THE FINAL we will publish the user name, town
and
country of the winner but it may take up to 30 days to publish more and
that is only if they allow this.
Q.
How do I know the competition is fair?
A.
First it will be in the public eye so only any one with
genuine
intent and acting in good faith would do this.
We have
and are acting in clear conscience and full accordance with our terms
and conditions. We are aware that there are a minority of
entrants that are not genuine but these are not in anyway connected to
ourselves, and details are time consumingly being logged.
Q How
do I know your solicitors are genuine
A.
The solicitor will be a member of the law society.
Q How
will you know if someone "pretends" to be the winner when they are
not?
A
Internet access to any website whether just to
view or
register for
any purpose creates an electronic paper trail and therefore people can
be traced. By the time we reach the final stage we will have
communicated with the weekly successful entrants who have the
opportunity to go forward to the final for their personal details and
will be satisfied on the face
of it.
The
terms and conditions clearly state that proof of who the winning person
is, is required. other than just the email user name and town
so
by the
time the Final selection has been made and the prize ready to be handed
over we should have reasonable
proof that they are the winner.
The
winner will be drawn by or at least in the presence of a solicitor,
the house
conveyed by a solicitor who will ensure that all is in order before the
conveyance is finalized. Anyone who is not legally entitled
either by age, geographical territory, legal title to the entry email
or any other reason will be disqualified. Don’t forget also
it will have web and hopefully TV coverage.
Q.
Why
should I tell anyone else about the competition?
A.
Well it's always nice to do something good for other people think how
different the world would be if everybody practiced random
acts
of kindness. You would make someone feel really
great if you like them enough to tell them
of something that in effect could lessen your own
opportunity. You would probably feel great wouldn’t
you if someone told you about this, because you would feel that they
genuinely liked you enough, that they were prepared to lessen their
chance for you. If you don’t feel like doing it for
that reason which we genuinely hope you do, then simply get together
with
friends as people do by
all agreeing to split the prize you win.
You
don’t have
to live in it, you could sell it and share the money.
The
house had planning permission which ran out recently but should be
easily renewable. This is to build a whole second level and we have
been told by a couple of estate agents (only verbally during
conversation) that the plot would, subject to further planning
permission actually take 6 terraces or 12 flats if
it were knocked down so a developer might be interested.
Ideally we
hope that doesn’t happen it’s a beautiful character
house that would make a lovely home for someone. Its
spacious enough in size due to it's layout (and subject to
rooms
being divided or the extension built
to house 2 families comfortably we believe this as we have in the
past
had groups of two to three friend or generations of families interested
in purchasing it. A few friends could live together without
driving each other crazy, so even if you are not bothered
with
clocking up karma there's good reason.

Q.
I want to do the same with my house can you help.
A Please contact us AFTER the success of this competition.n
Please be aware though
that
it
might take time to get back to you but we will. You should
receive an automatic
response if we receive your e-mail in which case we will
definitely get
back
to you. If you do not receive an automatic response it means we did not
receive your e-mail so try again.
Q.
Why
are you doing this & not selling your house the "normal way?"
A. Well
as
you will be aware housing activity has been and still appears to be sluggish
and we want to ensure the mortgage
company and creditors are
paid money owed.
The
idea has been
there for a few years but due to being self employed we did
not
have any time to act upon it but now for reasons mentioned in
the
why / about page have had to. A few years ago we read
about a woman further north than us who was
giving her house away in a raffle or competition ( I forget
which) as she couldn’t sell it due
to
harassment
from
people who had devalued her property (If this happens to you seek legal
advice as any such people would be liable for loss of chance /
opportunity devaluation in price)
We were genuinely
touched
by her plight and we were inspired us to do consider doing the
same but due to
both being self employed and the circumstances referred to in the WHY
/ABOUT page were too busy. We
thought about advertising paying gpt it due to the fact that
people might be wary about buying tickets for a competition over the
Internet from other
than
trusted recognized sources and did not want it to hinder the
success of
it. We shelved it for a time due
to
not enough time but our circumstances dictated that we had best be
putting this to market.
Q
Why do the daily and weekly successful entrants / finalists
only get to win opportunities of a place in the final not
anything else.
A
Well
1. Well as in any process that eliminates by way of semi /
quarter finals we believe that the increased opportunity provided to
successful entrants by the daily and weekly stages are a benefit in
themselves.
2. In order to keep down the advertising costs as
much as possible.
.
The daily successful entrant / finalist wins / gains the opportunity to
be one of only 140 potential entrants to obtain a place in the weekly
selection process and in turn any successfully
selected entrant of
the weekly processes gains an automatic entry / place
in the final which
will have no
more than 21 finalists
Due to circumstances beyonf our control altering many aspects of this
competition including time span there will be more than 140 finalists
in each of the 4 remaining weekly finals but still no more than 21
actual finalists. Details of why this is are mentioned above and
elsewhere on this site. Please feel fre to contactb us to ask more
if we have not explained this fully.
Q.
It
sounds too good to be true. Is it?
A.
It is as
straightforward as it can be. Its being in done in absolute good faith
to not only help our selves in order that we may pay all our creditors and carry on,
but a lucky
winner, the advertisers and as many good causes as possible.
There is no intended or known catch and remember not only
will a solicitor
and
the media be watching we are planning to go on do
this on a
grand
but sustainable to all scale after.
Q.
Where is the advertising money fund being held.
A. Revenue money will be held in pay pal initially if paid for through this method then transferred to
a separate bank account, all overseen by our solicitor (once
such
is in place and the funds will remain in pay pal until then) and at
the
end, despite this being run as a personal business venture, a
list of accounts will be made available to the public.
Q.
Is
this competition legal?
A.
We
have spent 11 months ( alongside legal, health and delaying issues) on
this project from learning to build it and manually inputting
thousands of codes
(checking them over and over again) all the while
researching the law including gambling, property,
charity, tax and other areas of law to ensure this is a legitimate
Prize Competition. It is
not a lottery or raffle it is a Prize Competition with a challenge
included and no entry or other fee (we have ensured all angles are
covered) and
therefore this is a perfectly legal free
prize competition.
We have
done this in a different manner to other past attempts by people to
personally dispose of
property by doing this in a manner that we as a self employed
partnership will legally, as permitted by the Law of Property
Act,
purchase the property from our self in our personal capacity therefore
ensuring we in our personal capacity reap only the market value,
however as we are doing this in a self employed commercial
capacity we are subject to VAT, and after all operating costs TAX on
any
remainder.
Any
such remainder after tax will be used to pay all our remaking
creditors (though we hold the honest belief, in knowledge of the
appropriate law, that some do not legally own our debts so we
intend to ask a few of these to write of the debt as far as they are
concerned and we will give the full amount
of money to
charities. (This is a separate intention to giving some money to the charities mentioned above.)
Q.
Still have a question?
A.Then
please email us via the contact page and we will answer
your question as soon as we can. If you do not receive an automatic
response e-mail again. Please be aware though that we are
inundated with e-mails which may mean it takes a while
to respond but we will.
GOOD
LUCK
May you all be blessed with the strength and support you
need to be happy.
